## What we do for rental buildings

We inspect apartments and common areas for mold and the moisture behind it, remove mold to a written plan, check the finished work, and give you reports you can keep on file or show HPD. That covers turnovers, yearly Local Law 55 inspections, tenant complaints and HPD mold violations.

- [Turnover inspections](https://sbgenvironmental.com/local-law-55/)

Before a new tenant moves in. Local Law 55 requires vacant apartments to be thoroughly cleaned and free of mold and pests first, and our report is your dated record that the apartment was checked.

- [Yearly Local Law 55 inspections](https://sbgenvironmental.com/local-law-55/)

Each occupied apartment and the common areas, on a schedule agreed for your building, with the findings written up apartment by apartment.

- [Tenant complaints](https://sbgenvironmental.com/mold-inspection/)

When a tenant reports mold, we inspect and write down what's there, how big it is and the likely moisture source, with photos and readings.

- [HPD mold violations](https://sbgenvironmental.com/hpd-mold-violations/)

Help with what the violation needs: assessment and clearance, mold removal, and the documents HPD asks for to certify the correction.

- [Mold removal in occupied buildings](https://sbgenvironmental.com/mold-remediation/)

The work area is sealed off and the air HEPA-filtered, so hallways and the apartments around it stay clean while we work.

- [Post-remediation clearance](https://sbgenvironmental.com/post-remediation-clearance/)

A licensed assessor checks the finished work, and for buildings covered by Local Law 61 files the post-remediation assessment with DEP within 7 days of the work being finished.

## The rules by building size

Which NYC mold rules apply depends on how many apartments the building has, and whether HPD has issued a violation:

3 or more apartments: Local Law 55

Inspect each occupied apartment and the common areas for mold and pests every year and when tenants complain, fix the cause using safe work practices, clean vacant apartments before a new tenant moves in, and give tenants a notice about indoor allergens with the lease.

10 or more apartments: Local Law 61

For mold of 10 square feet or more, use a licensed mold assessor and a licensed mold remediator. The remediator files with DEP at least two business days before work starts, and the assessor files the post-remediation assessment within 7 days of the work being finished.

Any building with an HPD violation: HPD deadlines

Correct and certify by the date on the notice: 90 days for Class A, 30 days for Class B and 21 days for Class C mold violations, counted from the date of service.

Local Law 61 also covers buildings on zoning lots with 25,000 square feet or more of non-residential floor area. For the full steps to close a violation, see [how to clear an HPD mold violation](https://sbgenvironmental.com/hpd-mold-violations/).

## Records that back you up

- **Before the visit**, we check the building's HPD violation history on NYC Open Data, so we know about open mold violations before we arrive.
- **Every report** lists each area with its size, moisture readings, the likely source and captioned photos, so your super or contractor knows what to fix.
- **Every price is in writing** before work starts: remediation proposals are priced area by area, and nothing is done that isn't in them.
- **For HPD**, the documents match what was really done, which matters because a false certification can lead to penalties.

## Getting started

1. **Tell us about the building:** the address, how many apartments it has, and whether there's an open HPD violation or a tenant complaint.
2. **Agree the scope and price:** which apartments and common areas, and when.
3. **Inspection and report:** we visit, and you get a written report with what to do next.
4. **If mold needs to come out:** a written proposal priced area by area, then the work, then clearance.

## Questions

### Does an apartment need a mold inspection before a new tenant moves in?

In NYC buildings with three or more apartments, Local Law 55 requires vacant apartments to be thoroughly cleaned and free of mold and pests before a new tenant moves in. HPD's guidance doesn't call for an outside inspector, but a turnover inspection by a licensed assessor gives you a dated, written record that the apartment was checked.

### What does Local Law 55 require from landlords?

Owners of buildings with three or more apartments must inspect each occupied apartment and all common areas for mold and pests at least once a year and when tenants complain, fix the underlying moisture using safe work practices, clean vacant apartments before new tenants move in, and give tenants a notice about indoor allergens with the lease.

[Local Law 55 inspections](https://sbgenvironmental.com/local-law-55/)

### How do I clear an HPD mold violation?

Fix the moisture source, have the mold removed by the right licensed professionals for your building, then certify the correction to HPD before the deadline on your notice, with the supporting documents. For Class B and C mold violations in buildings with 10 or more apartments, HPD asks for affidavits from both the licensed assessor and the licensed remediator, and HPD may reinspect.

### When does mold work need licensed professionals in NYC?

Under New York State law, mold assessment and remediation work on projects larger than 10 square feet must be done by companies licensed by the NYS Department of Labor. In New York City, Local Law 61 of 2018 adds that owners of buildings with 10 or more apartments must use a licensed mold assessor and a licensed mold remediator for mold of 10 square feet or more, and file with the Department of Environmental Protection.

### What are the mold laws in New York?

Statewide, Article 32 of the New York State Labor Law requires licensed mold assessors and remediation contractors for mold projects larger than 10 square feet, with exceptions, including owners, managing agents and their employees working on the owner's own buildings. New York City adds Local Law 55, which makes owners of buildings with three or more apartments inspect for mold every year and fix the cause, and Local Law 61, which requires licensed professionals and filings with the Department of Environmental Protection for mold of 10 square feet or more in buildings with 10 or more apartments.
